MetaGear Terms of Service

1. Introduction

Welcome to MetaGear ("App," "Service," "we," "us," or "our"). MetaGear is a mobile application designed to help hikers and outdoor enthusiasts create, manage, and share gear lists. The App is operated by an individual sole proprietor registered in Republic of Georgia.

By accessing or using MetaGear, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use MetaGear. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you may not access or use the App.

3. Account Registration

To access certain features of the App, you must create an account. You may register using:

• Email address (via one-time verification code)
• Google Sign-In
• Apple Sign-In

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Payments

4.1 Free Tier

MetaGear offers a free tier that includes core functionality with advertisements.

4.2 Paid Subscriptions

We offer paid subscription tiers that may include:

• Ad-free experience
• Premium features and enhanced functionality

Subscription details, pricing, and billing cycles are displayed in the App and through the respective app stores (Apple App Store, Google Play Store). All payments are processed through these platforms and are subject to their terms.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your app store account settings. Refunds are subject to the policies of Apple or Google, as applicable.

5. User Content

5.1 Your Content

You may create and upload content including gear lists, text, images, notes, and other materials ("User Content"). You retain ownership of your User Content.

5.2 License to MetaGear

By submitting User Content, you grant MetaGear a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for technical formatting), display, and distribute your User Content solely to operate, maintain, improve, and promote the App.

This license terminates when you delete your User Content, except where it has been shared with and retained by other users.

5.3 Public Content

Some features allow you to make content public. Public content may be visible to other users and may be shared further. Do not post sensitive personal information in public areas.

5.4 Content Restrictions

You agree not to upload content that:

• Is illegal, fraudulent, or violates any applicable law
• Infringes intellectual property rights of others
• Is defamatory, obscene, or harassing
• Contains malware or harmful code
• Violates the privacy of others

We reserve the right to remove any content that violates these Terms.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt unauthorized access to systems, accounts, or data
• Reverse engineer, decompile, or extract source code (except where permitted by law)
• Introduce malware or interfere with App operations
• Scrape or harvest user information
• Circumvent security measures or access restrictions
• Use automated systems to access the App without permission
• Impersonate others or misrepresent your affiliation

7. Intellectual Property

The App, including its software, design, trademarks, logos, and non-user content, is owned by MetaGear or its licensors and protected by applicable intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Third-Party Services and Links

8.1 Third-Party Services

The App may integrate with or link to third-party services. Your use of such services is governed by their respective terms and privacy policies.

8.2 Affiliate Links

The App may contain affiliate links to outdoor gear products and marketplaces. If you make a purchase through an affiliate link, we may earn a commission at no additional cost to you. See our Affiliate Disclosure for details.

8.3 Advertisements

The free tier of the App displays advertisements provided by third-party ad networks. These networks may collect information as described in our Privacy Policy.

9. Push Notifications

We may send you push notifications related to the App's functionality, updates, or promotional content. You can manage notification preferences in your device settings.

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Outdoor Activity Risks

Outdoor activities involve inherent risks. MetaGear does not provide professional safety, medical, or equipment advice. Any information in the App, including community content, is for informational purposes only and is used at your own risk. Always exercise proper judgment and consult professionals when necessary.

10.3 No Guarantee of Availability

We do not guarantee that the App will be available, uninterrupted, secure, or error-free at all times.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• MetaGear shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or goodwill.
• MetaGear's total cumulative liability for all claims shall not exceed the greater of: (a) amounts you paid to MetaGear in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless MetaGear from any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any law or third-party rights

13. Modifications to Service

We may modify, suspend, or discontinue the App (in whole or in part) at any time with or without notice. We may also introduce new features or impose limits on certain functionality. We are not liable for any modification, suspension, or discontinuation of the App.

14. Termination

14.1 By You

You may stop using the App at any time. You may request account deletion as described in our Privacy Policy.

14.2 By Us

We may suspend or terminate your access if:

• You violate these Terms
• Required by law
• To protect the App, other users, or our interests

14.3 Effect of Termination

Upon termination, your right to use the App ceases. Provisions that by their nature should survive will continue, including Sections 5.2, 10, 11, 12, and 15.

15. Governing Law and Disputes

These Terms are governed by the laws of Georgia (country), without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of Georgia, except where mandatory consumer protection laws of your jurisdiction require otherwise.

16. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice through the App or other means. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MetaGear regarding the App.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
